I think it is focused on law enforcement. That they can't use "drones" with cameras to gather evidence on individuals without a warrant or imminent threat. The House Public Safety Finance and Policy is meeting tomorrow (March 11) at 10:00 in 10 State Office Bldg to discuss.

Do you know the statue? Do you know of any laws restricting flying the phantom 2 and taking pictures?

You are correct...Sir. It is aimed at Law Enforcement, not us. I looked into it already.

A couple of things. The law has not passed in either Wisconsin or Minnesota. They are bills currently in the legislator and may be voted on this session. The bills in the Minnesota House and Senate currently state that it would be a felony to use a drone for the purpose of capturing an image of a person on public or private property without the permission of the person and the property owner. Again, these bills have not been passed and are not law.

I am still going to look into this and talk to my representative. Here is the loophole that they do not understand. You do not own the airspace above the reasonably usable height of your property. So if the statues in your city would limit you to a certian height for your house, let's just say, you are allowed to build a two-story house and put a TV antenna on it. Anything above that is not legally your airspace. So one could argue, but that would not be private land/property. I am not sure if they would consider that public airspace. On the other hand your image is captured on surveillance camera in public areas every day. This is an absolutely ridiculous law.

I agree. I'm not sure this is constitutional and I'm not sure local or state authority's have jurisdiction. It was just ruled that the FAA has to back down (pending appeal) but that's another matter.

It might take someone get charged with this and fight it in court. That's all assuming the law gets passed

So essentially fpv flying is ok just as long as the image is not captured or recorded? Flying with a camera is ok just as long as you have consent of all involved. I work in the big world of internet and I can guarantee you are safer standing outside getting your pic taken by a "drone" then your are logging on to Facebook.

So if Im at a park and take a picture of my kids with a person is in the back ground, thats perfectly fine, however if the pic is taken in the air it could be a felony???? I can understand restrictions going on peoples property and taking pictures, but how can they restrict public property? The whole "felony" talk is crazy extreme!

1.22    Sec. 2. [624.75] PRIVATE USE OF DRONES.
1.23    Subdivision 1. Definitions. (a) For the purposes of this section, the terms in this
1.24subdivision have the meanings given them.
2.1(b) "Dangerous weapon" has the meaning given in section 609.02, subdivision 6.
2.2(c) "Drone" has the meaning given in section 634.40, subdivision 1, paragraph (b).
2.3(d) "Person" means an individual, partnership, corporation, association, or other
2.4legal entity but does not include the state or a political subdivision.
2.5    Subd. 2. Prohibition on use of drone. A person is guilty of a felony if the person
2.6uses a drone to capture images of an individual on public or private property without the
2.7permission of the individual and the owner of the private property or appropriate public
2.8authority.
2.9EFFECTIVE DATE.This section is effective July 1, 2013, and applies to offenses
2.10committed on or after that date.
