The whole "in flight knowledge" thing is a bit complex and i'll let the FC experts speak to that, but with 9443s, if you really are constantly below 10% on throttle for more than a few seconds, that's generally a bad thing. Not saying you shouldn't be able to use the full range if your sticks, but i've learned it's always smoothest to come down with a very light touch, often no more than halfway between center and bottom. It's served me well for all my props, but especially the 9"!
 
It would be simple to distinguish between an "in flight" and on the ground situation.

If the throttle is below 10% for a while in flight, you have a high descend rate.

Sure it's a bad idea to do this, but sometimes people have bad ideas, and their reward should not be a shutdown of motors.
