What am I doing wrong???

Okay just opened up my brand new phantom, put the legs on, put batteries in and turned on controller, connected battery to phantom, lights are flashing like mad, green yellow, red and then try to take it off and engines wont spin at all. is it defective???

Well, be sure to read the manual.

Are you waiting for a solid single been blinking light?

once you get that,. to start the motors you need to do any of the stick combinations that are shown in the Quick start manual (page 13)

And it takes a good minute or so before the lights stabilize and you get just a single flashing green.
