Question was about location of public airspace and what would be trespassing. Trespassing is not automatic in public airspace if a person _might_ use it. More to the point, the property owner might have a right to damages if their right to use their land property is prohibited. They cannot own airspace, period. They, at best, have an easement to that airspace.

From what i gather, a UAS pilot has the right to fly from 0 - 400' in class G airspace (or other class with authorization). Of course, one should be mindful of others.
