Not really the OP's question either. There was no question as to what someone might have a right to use. So this is different. Question was about location of public airspace and what would be trespassing. Trespassing is not automatic in public airspace if a person _might_ use it. More to the point, the property owner might have a right to damages if their right to use their land property is prohibited. They cannot own airspace, period. They, at best, have an easement to that airspace.
