UK Height law question

In the UK the maximum height i can fly is 400 feet, i set my P4 to that, now my question is if i go to the top of the Malvern hills which is about a 1000 feet can i still fly 400 foot above them and if so how far can i fly away from them at what would be 1400 feet.
 
400 ft from ground level not sea level. So even though your app says 400ft you could break the rules if you fly over a valley from the top of the hill. It's never crystal clear and somebody might have a different view.

See I would say it's whatever ground you are stood on as a plane flying at 500 foot above the ground would still be 500 foot above a 1000 foot hill but at what distance from that hill could I stay at that height. I'm guessing a sensible distance is the obvious answer but is it written in law.
