if it was no planes would be in the sky just have to make good judgment's where to fly over a nuclear plant or federal building not smart

In the US, the FAA says it's legal. Their position is that airspace belongs to them above a reasonable use height limit. 80 ft above any structure is often cited as the end of private air space. It's an older law that has not been challenged in court recently with proliferation of UAVs.

Assuming you're not asking about restricted areas and NFZ's, of course.

Keep in mind that it's possible there are some other circumstances that you may need to deal with such as safety, privacy, courtesy, and moral dilemmas. Some people have regretted pushing the "legal to fly over homes/land" when they created a firestorm in their neighborhood where they live each and every day. Sometimes you can win the battle and still lose the war LOL.

Sometimes just because you "can" do something doesn't mean yo should.
