Well, insurance is made to cover accidents... Flying along birds that don't care but one happens to have a bad day and does attack anyway is an accident, flying along ones that are known to attack is stupidity, just don't do it / if you do it's your problem, other people who fund the insurance don't want to pay for your recklessness.
