I said they 'probably could', but I will clarify that you should fly within the letter of the law and comply with all NOTAMs and TFRs issued in your area.

inside the TFR area, no flight of UAS is allowed per the NOTAM (under the PL 112-95 sect 336, you could make an argument that they decided not to regulate 'hobby aircraft' under 400' and within LOS that did not pose a danger to the NAS; however i doubt the FAA would be very receptive to this...
