If I am a commercial real estate agent and sometimes use my drone to take aerials to put in a marketing package. Is that considered commercial use? I do not sell my books or sell the pictures. Any thoughts?

Go to Udemy and take one of the classes. Teaches you everything. Laurence Seberini has a Phantom Film School. I highly recommend it. He is excellent.

I use both but Litchi definitely preferred. Very easy to use and does an amazing job; especially if you have a specific mission you want to fly.

An HOA can ban them. Penalty would be to remove club and community privileges. Why provoke the guy when you can just avoid his house. I fly my drone in my Boca community and no one bothers me. Probably the same one. I am just respectful of not getting too close to other homes or too low...

What community are you in? WCC? Please try not to upset the person or the HOA will ban drones and that would be a bummer. These co do commandos can do whatever they want within the walls. Better not to upset them and be as respectful as you can and they will leave you alone.
